These Terms and Conditions ("Terms") govern your use of the website bodhxfit.com, our physical gym facility, and all related services provided by Bodh Lifestyles LLP, operating as BodhXfit ("BodhXfit," "we," "us," or "our").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.
1. General Terms and Acceptance
1.1. The Services: BodhXfit provides functional fitness, CrossFit, and group training services at our facility located at Sco-5 second floor Huda main market sector 31 Gurgaon Haryana. Our website (bodhxfit.com) is used for marketing, membership sales, class scheduling, and communication.
1.2. Eligibility: Membership and participation in our classes are open to individuals who are 18 years of age or older, or minors who have provided written consent from a parent or legal guardian.
1.3. Modification of Terms: We reserve the right to modify these Terms at any time. We will notify members of significant changes via email or by posting an updated version on our website. Continued use of the Services after such changes constitutes your acceptance of the new Terms.
2. Membership and Payment
2.1. Membership Contract: All gym memberships constitute a contractual agreement between you and Bodh Lifestyles LLP. Membership details, including fees, duration, and cancellation terms, are specified in the separate Membership Agreement signed upon registration.
2.2. Fees and Payment: All membership fees, class fees, and other charges are due on the dates specified in your Membership Agreement. Failure to pay fees on time may result in suspension or termination of your membership and access to the facility.
2.3. No Refunds: Membership fees, class fees, and other purchases are generally non-refundable, except as expressly provided in the Membership Agreement or as required by applicable law.
3. Use of the Facility and Conduct
3.1. Assumption of Risk: You acknowledge that participation in CrossFit and functional fitness activities involves inherent risks of serious injury, physical damage, or even death. You voluntarily assume all risks associated with your use of the BodhXfit facility and participation in all activities.
3.2. Health and Safety: You represent that you are physically fit and have no medical condition that would prevent your safe participation in the training programs. You must inform the coach immediately of any pain, injury, or medical concern.
3.3. Rules and Regulations: You must adhere to all rules and regulations posted at the facility and instructed by the BodhXfit coaches and staff. This includes equipment usage, class scheduling protocols, and facility access hours.
3.4. Coaching Authority: All participants must follow the instructions and directions of the BodhXfit coaches during classes and training sessions. Coaches have the right to ask any participant to cease an activity or leave a class if they deem the participant's conduct or physical condition unsafe.
3.5. Code of Conduct: Disruptive, abusive, or inappropriate behavior towards staff, coaches, or other members is strictly prohibited and grounds for immediate membership termination without refund.
4. Website and Digital Services
4.1. Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify BodhXfit immediately of any unauthorized use of your account.
4.2. Accuracy of Information: You agree to provide current, complete, and accurate registration and payment information.
5. Intellectual Property
The content on the bodhxfit.com website, including logos, text, graphics, and our unique WOD programming, is the property of Bodh Lifestyles LLP and is protected by intellectual property laws. You may not use, reproduce, or distribute any content without our prior written permission.
6. Limitation of Liability and Indemnification
6.1. Limitation of Liability: To the maximum extent permitted by law, Bodh Lifestyles LLP, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, incurred by you or any third party, whether in an action in contract or tort, arising from your access to or use of the Services or participation in activities.
6.2. Indemnification: You agree to indemnify and hold harmless Bodh Lifestyles LLP from any claims, damages, liabilities, and expenses (including attorney's fees) arising out of your violation of these Terms, your unsafe conduct in the facility, or your misuse of the Services.
7. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, specifically the jurisdiction of the courts in Gurugram, Haryana. Any dispute arising out of or in connection with these Terms shall be first attempted to be resolved through good faith negotiation. If unsuccessful, disputes shall be submitted to binding arbitration in Gurugram, Haryana.
